Terms of Service

These terms cover your use of the FOUND. website. By using the site, you agree to these terms. If you do not agree, please do not use the site.

About FOUND.

FOUND. is the trading name used by Chris Loftus to provide independent, buyer-side vehicle sourcing services in the UK. Information on this website is general information about the service and is not an offer to buy or sell a vehicle.

Enquiries and sourcing period

Submitting the enquiry form does not create a client relationship or commit either party to proceed. If you instruct FOUND., we will confirm your agreed vehicle brief and the search start date in writing. The initial sourcing period is 30 days from that start date. We search and assess candidates against the agreed brief; vehicle availability and seller decisions are outside our control, and we do not guarantee that a vehicle will be purchased or that every preference can be met.

Fees

The sourcing fee is payable when the search begins. It is £399 for a vehicle priced at £40,000 or less. For a vehicle priced above £40,000, the fee is 1% of the vehicle price, capped at £1,500. The fee covers up to three candidate assessments against the agreed brief. Any applicable VAT and the final fee will be made clear before you instruct FOUND. Third-party services and costs are not included and require your agreement before they are incurred.

14-day cancellation period

If you enter a service contract with FOUND. online, by phone or away from our business premises, you can generally cancel it within 14 days starting the day after the contract is made. To cancel, email hello@foundautomotive.co.uk with a clear statement that you are cancelling. You may also use the model cancellation form linked below, but it is not mandatory. We will refund payments due under the cancellation rules within the required period using the original payment method unless you agree otherwise.

Requesting an early start

We will not start work during the 14-day cancellation period unless you expressly ask us in writing to do so. If you then cancel during that period, you may have to pay an amount proportionate to the work supplied up to cancellation. If the service is fully performed during the period, you will lose the cancellation right only after giving the required prior express consent and acknowledgement. We will obtain and record these confirmations separately when you instruct us; submitting the website enquiry form is not consent to start work.

Cancellation and refunds after the 14-day period

After the statutory 14-day period, you may cancel by emailing us. If no suitable candidate has been presented, FOUND. will refund 50% of the sourcing fee. If a suitable candidate has been presented against your agreed brief, the sourcing service is considered delivered and no discretionary refund is due merely because you decide not to buy. This does not affect your statutory rights or remedies. Any approved third-party costs remain subject to the relevant provider’s terms.

30-day sourcing promise

If FOUND. has not presented a suitable candidate within 30 days after the agreed search start date, you may choose either (a) a refund of 50% of the sourcing fee, or (b) for FOUND. to continue searching at no additional sourcing fee, with a revised end date agreed with you in writing. For a £399 fee, 50% is £199.50. Any approved third-party costs are not included in this refund. This promise does not limit any consumer rights or remedies you may have under applicable law.

Scope and limitations of vehicle checks

Our advert, specification, MOT, seller and available-history research is desk-based and relies on information available from sellers and third parties at the time of checking. It is not a physical or mechanical inspection, valuation, guarantee of title, condition or history, or substitute for your own checks. Information may be incomplete, inaccurate or change after review. We will explain the checks carried out and their limits, and you remain responsible for deciding whether to buy.

Third-party inspections and services

Independent physical inspections, vehicle-history reports, valuations and other third-party services are separate from the sourcing fee. We will agree any such service and its cost with you before arranging it. The provider is responsible for its own service, report, terms and conclusions; FOUND. does not control or guarantee a third-party provider’s work. Where possible, you will contract with and pay the provider directly.

Website use and intellectual property

Please do not misuse the site, interfere with its operation, or attempt unauthorised access. The site’s text, branding and design belong to FOUND. or its licensors and may not be reused commercially without permission.

Liability

Nothing in these terms limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights. FOUND. is not responsible for the independent work or conclusions of a third-party provider, but this does not exclude FOUND.’s own responsibilities for the sourcing service it provides.

Governing law

These terms are governed by the laws of England and Wales. Courts in England and Wales will have jurisdiction, subject to any mandatory consumer protections that apply where you live.
